The terms, in plain language

These Terms & Conditions (the "Terms") govern your use of the Launch Digital website and platform (the "Service") provided by Launch Digital, Inc. ("Launch Digital", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business, and these Terms apply to both you and that business.

You own your business. We just help it grow. Two things in particular will always belong to you:

Your domain name: the website address (for example, YourBusinessName.com) is registered in your name and under your account. You can point it at any provider at any time. It is never locked to our platform.

Your customer list: every client name, phone number, and email you collect is yours. You can export all of your contacts at any time, in a standard format, whether or not you continue using Launch Digital. We never restrict exports or charge a fee to access your own data.

Every lead your website captures is saved to your account and is part of your exportable customer list. Your website content and your review and reputation history on Google also belong to you.

As part of the Service, Launch Digital may send automated text messages on your behalf, including missed-call text-back replies, lead follow-up sequences, review request links, appointment reminders, and marketing campaigns.

By providing a phone number, you (and your customers, when they opt in through your website or forms) consent to receive these automated SMS messages. Consent to receive messages is not a condition of purchasing any goods or services.

Message frequency varies. You may receive multiple messages per week depending on the campaigns and automations you have enabled.

Message and data rates may apply. Check with your mobile carrier for details.

Carriers are not liable for delayed or undelivered messages.

To opt out of SMS messages at any time, reply STOP to any message you receive. You will be unsubscribed and receive no further messages. To request help, reply HELP to any message. You can also contact us at hello@launchdigital.app to opt out.

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

The current plan and pricing are listed on our pricing page. Fees are billed in advance on a recurring monthly basis. Unless otherwise stated, fees are non-refundable.

You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. There are no early termination fees. You retain access to the Service, and the right to export your data, until the end of that period.

We may change our fees upon reasonable notice. Any price change takes effect at the start of your next billing cycle after the notice.

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Service.

You are solely responsible for the content of any messages sent through the Service, for obtaining proper consent from recipients before sending SMS or email, and for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state or local regulations.

You may not use the Service to send unsolicited messages, to transmit unlawful, harassing, or misleading content, or to violate any carrier or messaging provider guidelines.

The Service, including its software, design, and branding, is owned by Launch Digital and is protected by intellectual property laws. These Terms do not grant you any right to use the Launch Digital name or trademarks except as expressly permitted.

All content you upload or create within the Service, including your website content, customer data, and message templates, remains your property as described in the ownership section above.

We respect your privacy. We collect and use personal information only as described in this section and as necessary to provide the Service.

We collect the contact and business information you provide when you sign up, the customer data you choose to store in the Service, and standard usage and technical information such as device type and access times.

We use this information to operate and improve the Service, to communicate with you, to send messages on your behalf through your automations, and to comply with our legal obligations.

We do not sell your personal information or your customer data. We may share information with service providers who help us deliver the Service (such as hosting and messaging carriers) under agreements that require them to protect it.

As emphasized throughout these Terms, your customer list is yours. You can request export of your data at any time, and you can request deletion of your data when you close your account.

We take reasonable technical and organizational measures to protect your data, including encryption in transit and at rest, access controls, and regular security reviews.

No system is perfectly secure, however. You are responsible for keeping your account credentials safe and for promptly notifying us of any unauthorized access. We are not liable for losses caused by compromised credentials you failed to protect.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will generate any particular number of leads or booked jobs.

To the maximum extent permitted by law, Launch Digital shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising out of your use of the Service.

Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if your account remains inactive, or if we stop offering the Service altogether.

Upon termination, your right to use the Service ends, but your right to export your data remains available for a reasonable period. Sections of these Terms that by their nature should survive, including ownership, intellectual property, disclaimers, and limitation of liability, will remain in effect.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after any changes take effect constitutes acceptance of the updated Terms.
